From today's minority opinion in Snyder v. Phelps et al. in which a 8-1 decision allows the shall-not-be-named Topeka based hate group to continue to picket funerals:
“In order to have a society in which public issues can be openly and vigorously debated,” he wrote, “it is not necessary to allow the brutalization of innocent victims.”
